(a) “Mr. Window” refers to “Mr. Window Cleaning Melbourne,” registered under ABN 47 664 553 164, and encompasses all employees of the company.
(b) “Client” refers to you, the individual or entity purchasing goods or services from “Mr. Window,” as stipulated in the sales contract.
(c) “Works” refers to any goods and/or services provided by “Mr. Window” to the “Client” in accordance with these terms and conditions.
Application of CCA and FTA:
(a) Nothing in this agreement is intended to contract out of any provisions of the Competition and Consumer Act 2010 (“CCA”) or the Fair Trading Acts (“FTA”) in each of the States and Territories of Australia (including any substitute or re-enactment of those Acts), except to the extent permitted by those Acts where applicable.
(b) Where the Customer purchases Services as a consumer, these terms and conditions are subject to any laws or legislation governing the rights of consumers.
(c) These terms and conditions shall not affect the consumer’s statutory rights.
(a) Agreement: These terms and conditions (“Terms”) constitute a legally binding agreement between Mr. Window and the Client concerning the provision of goods and/or services by Mr. Window to the Client.
(b) Acceptance: The Client is deemed to have accepted and is bound by these Terms when:
– The Client instructs Mr. Window to provide any goods and/or services.
– The Client accepts such goods or services.
– The Client accepts these Terms in any other manner recognized by law.
(c) Amendments: These Terms may only be amended by mutual written agreement between the parties.
(d) Incorporation of Quotes: The Client acknowledges and agrees that these Terms and Conditions shall be read in conjunction with any quotation provided by Mr. Window in relation to the goods and/or services.
(e) Assignment and Subcontracting:
– Mr. Window reserves the right, at its sole discretion, to sub-contract, assign, or license any part of its rights and obligations under this agreement.
– The Client may not assign or transfer any of its rights or obligations under this agreement without the prior written consent of Mr. Window.
(a) Fixed Price Quote: All quoted written by “Mr. Window” are fixed and final quote whether the quote is determined by site visit, photographs provided by the client, Google Maps/Street view (Online methods). If the condition of the site worsens between the time of the quote and when the quote is accepted, or there are factors which are not apparent from photographs or online methods, for example extensive build-up of dirt/debris, accessibility issues, renovations/extensions, gutter guards or other items, then additional charges may apply, and we reserve the right to amend the quote accordingly.
(b) Post Build/Construction Quote: in relation to post build/construction window cleans, which involve a more specialised style of window cleaning, including removing paint, removing builders debris (such as caulking, concrete splatter, render and plaster) and other types of residue from glass and glass frames. Quotes for post build/construction cleans will only be based on a site visit or photographs of all windows and frames.
(c) Validity of Quotations: Quotations provided by Mr. Window are valid for 30 days from the date of the quotation unless otherwise specified in writing.
(a) Residential Client: Unless otherwise specified in writing, no deposit is required for residential clients. Payment terms are strictly Cash on Delivery (C.O.D.). Payment must be made on the day of service completion by “Mr. Window.”
(b) Commercial Client: Unless otherwise agreed by “Mr. Window” in writing, a deposit as stated in the quote is required from commercial clients upon acceptance of quote to secure booking. This deposit is strictly non-refundable except in the event of contract cancellation due to job unfeasibility by Mr. Window. The remaining balance is due within 7 days of the completion of work, without any allowance for deduction, retention, or set-off of any kind.
(c) Payment Method: Payment will be made by credit card (excluding American Express), or by cash, or by direct bank transfer, or by any other method as agreed to between the Client and Mr. Window.
(d) Overdue Invoice: The client shall be liable for payment of interest at the rate stipulated in terms of the Penalty Interest Rates Act (VIC), as varies from time to time, with effect from due date. In the event of Mr. Window incurring any costs (including legal costs) in order to recover any amount owing in terms of these terms, or to enforce its rights in accordance with these terms, the Customer agrees that it will be liable for the legal costs of Mr. Window on a solicitor and own client basis and/or any collection agency costs.
(a) By “Client”: In the event that a client wishes to reschedule or cancel a service, a minimum of 48 hours’ notice is required for rescheduling and 72 hours’ notice for cancellation. Failure to provide sufficient notice will result in additional charges or the forfeiture of the deposit, where applicable, to cover any costs incurred by “Mr. Window.”
(b) By “Mr. Window”: “Mr. Window” reserves the right to cancel or reschedule a service due to unforeseen circumstances such as adverse weather conditions, equipment failure, or other exigent factors. In such cases, reasonable efforts will be made to reschedule the service at a mutually convenient time for both parties. In no event will “Mr. Window” be held liable for any other losses, including loss of profit or consequential loss.
(a) Standard Window Cleaning Service: The client acknowledges that, unless otherwise specified in the quote, the provided window cleaning service quotes are for a standard window maintenance clean, which includes the cleaning of the window glass panels in the closed window condition, wiping of the window frames, sills, and reveals, as well as the removal of cobwebs from the vicinity of the windows.
(b) Window Glass Panel: A standard window cleaning service includes removal of dirt, grimes, and cobweb from glass panel – streak free result. Paint scaping, graffiti removals, sticky residue, post build/construction debris (such as concrete or mortar splatter), hard water stains (calcium buildup), stubborn harden marks are not included in a standard window cleaning service.
(c) Flyscreen: Flyscreens (if any) will be removed and reattached by Mr. Window during the cleaning of glass. In the event of screw-in, difficult-to-reach, or non-detachable flyscreens due to safety concerns and the risk of damage, Mr. Window will not remove these flyscreens, and as a result, the associated glass cannot be cleaned. For clients opting for flyscreen softwash, additional charges will apply as per the quoted price. The client will need to inform the Mr. Window at the beginning of the work commencement to ensure appropriate arrangements, and these additional charges will be added to the final invoice.”
(d) Window Tracks / Runners: Tracks/Runners are not included in standard window cleaning service by Mr. Window, additional charges will apply as per the quoted price. The client will need to inform the Mr. Window at the beginning of the work commencement to ensure appropriate arrangements, and these additional charges will be added to the final invoice.
(e)Frames & Sills: As part of the standard window cleaning service, the wiping down of window frames and sills is included. Any instances of heavy mold build-up, requiring specialized treatment beyond the scope of standard maintenance, may incur additional charges.
(a) Site Access: The client acknowledges the importance of providing unobstructed and safe site access for the window cleaning team. It is the client’s responsibility to ensure that designated areas requiring window cleaning services are easily accessible and free from any obstacles or hazards. Failure to provide adequate site access may result in an inability to perform the agreed-upon services, and Mr. Window will not be liable for any resulting consequences or service disruptions.
(b) Water & Electricity Access: The client acknowledges the necessity of providing accessible water and electricity sources during the window cleaning process. It is the client’s responsibility to ensure that reliable water (non-recycle) and electricity access is available on-site for the duration of the service. Any limitations or disruptions to water and electricity access that impede the window cleaning process must be communicated to Mr. Window in advance to facilitate appropriate arrangements and prevent any service delays.
(a) In the event of any issues or concerns regarding the window cleaning service provided by Mr. Window, the client is required to notify Mr. Window within 24 hours of the service completion. Any complaints received after this period may not be considered.
(b) Upon completion of the work, a Mr. Window technician will generally conduct a thorough walk-through with the client to seek approval of the work and ensure client satisfaction. It is strongly suggested that any concerns or issues be raised during this walk-through to facilitate immediate resolution. The client must provide specific details of the complaint along with any relevant evidence to ensure a comprehensive and efficient investigation. Mr. Window will make every effort to address and resolve the complaint in a professional and timely manner.
(c) These provisions are reinforced by Mr. Window’s dedication to providing a 100% customer satisfaction guarantee within the framework of these terms and conditions.
(a) In the event of any breach of the present terms and conditions by Mr. Window, the remedies available to the Customer are confined to damages, which shall not surpass the aggregate price of the goods and/or services, irrespective of the circumstances. Moreover, Mr. Window shall not assume liability for any consequential losses or expenses, inclusive of, but not limited to, loss of profits, resulting from any breaches of the aforementioned terms and conditions.
(b) Neither party shall be deemed liable for any breach of contract, default, delay, or failure to perform any obligations detailed within these terms and conditions, which arise from any force majeure events, acts of God, or any other uncontrollable events beyond the reasonable control of the party.
